FlightSim.asia Purchase Terms

These Purchase Terms apply whenever you buy a Payware Item on FlightSim.asia. They supplement, and have precedence over, our Terms of Use for anything relating to a purchase. You must acknowledge these Purchase Terms before completing an order.

1. Definitions

Terms not defined here have the meaning given in our Terms of Use. In these Purchase Terms:

"Platform", "we", "us", "our" means FlightSim Asia Pte. Ltd. (UEN 202539554H).
"You" means the Customer placing an order.
"Payware Item" means paid digital content offered for sale on the Platform.
"Order" means your purchase of one or more Payware Items in a single transaction.
"Sale Price" means the total amount you pay for an Order, inclusive of any tax we collect.

2. Who you're buying from

When you place an Order, you are buying from FlightSim Asia Pte. Ltd., as the merchant of record for every Payware Item sold on the Platform. Your purchase contract is exclusively between You and Us.
The payware item's developer, designer, creator, publisher, etc, is not a party to your purchase contract and has no obligations to you directly under it. Issues about your order should be raised directly with Us.

3. Price & payment

The price shown to you at checkout is the Sale Price for your Order, in the currency displayed. It may differ from the item's base list price due to regional pricing, and is the final amount you'll be charged.
Payment is processed through our payment partner. By placing an Order, you authorise us to charge the payment method you provide for the Sale Price.
We may cancel or refuse an Order — for example, for suspected fraud, pricing errors, or payment failure — before it is completed. If we do, you won't be charged, or will be refunded if you already were.

4. Delivery & access

Payware Items are delivered digitally. On successful payment, the item becomes available in your account library for download. If any serial keys
You're responsible for having a device, software version, and simulator compatible with the Payware Item before purchase. Compatibility information provided on the listing is for guidance and isn't a guarantee.

5. Licence to use what you buy

On successful payment, we grant you a non-exclusive, non-transferable, revocable licence to download, install, and use the Payware Item for your own personal, non-commercial flight simulation use.
You must not resell, sublicense, rent, redistribute, or share the Payware Item or your access to it, or use it for any commercial purpose, without our prior written permission.
You must not reverse engineer, decompile, or modify the Payware Item except to the extent applicable law gives you the right to do so despite this restriction.
You may install the Payware Item only on your own personal computer devices excluively for use in accordance with these terms.
This licence continues for as long as you comply with these Purchase Terms, even if the Payware Item is later removed from sale to new customers, except where Section 8.2 applies.

6. Refunds

Our default position is that sales are final. We may, at our discretion, issue a refund outside of that default position — for example, where a Payware Item is materially defective or not as described.
Where the law of your country of residence gives you a statutory right to a refund that these Purchase Terms don't already provide, we will honour that right. Section 7 explains one such right and how it applies to digital content specifically.

7. Right of withdrawal for digital content (EU / UK customers)

If you're a consumer resident in the European Union or United Kingdom, you may ordinarily have a 14-day right to withdraw from an online purchase without giving a reason.
For digital content delivered immediately, like a Payware Item, this right ends once delivery begins — but only if you've expressly asked for immediate delivery and acknowledged that doing so ends your withdrawal right.
Before you complete an Order, if this applies to you, we will ask you to separately confirm: "I want this digital content delivered to me immediately, and I understand that I lose my right to withdraw from this purchase once delivery begins." You must actively check this box — it is not combined with your general agreement to our Terms of Use, and it is not pre-checked for you.
If you don't check that box, delivery of your Order will be delayed until the 14-day withdrawal period has passed, or until you separately confirm you want immediate delivery.
Nothing in this Section affects any other statutory right you may have.

8. Availability & changes

We may update, discontinue, or remove a Payware Item from sale at any time, including in response to a rights claim against it. This doesn't affect your rights under Section 5 for a Payware Item you already purchased.
If we are required to remove a Payware Item following a rights claim, we will not revoke your existing licence or redownload access to a copy you already purchased, unless required to do so by law or court order.

9. Limitation of liability

To the fullest extent permitted by law, our total liability to you arising from an Order is limited to the Sale Price you paid for it.
Nothing in these Purchase Terms limits liability that can't be limited under applicable law, including liability for death, personal injury, or fraud.

10. Your other consumer rights

These Purchase Terms don't affect any mandatory statutory consumer protection you're entitled to under the law of your country of residence, where that law applies to your purchase.

11. Governing law

These Purchase Terms are governed by the laws of Singapore, without prejudice to Section 10.
Should any part of these Purchase Terms be found legally void, the remaining parts remain in force.

12. Changes to these terms

We may update these Purchase Terms from time to time. The version in force at the time of your Order applies to that Order.
